Andrew G. Wells is a Partner in the firm's Property Practice.

Andrew specializes in real estate transactions and conveyancing, sales and structuring for both high-end and private client matters and large commercial transactions.  His practice covers mortgage-backed financing and loans, property title due diligence and opinions, title insurance, subdivision, resort and hotel planning development and operations, commercial and residential leases and related tax matters and issues and in advising on and applying for all governmental and requisite approvals.

Recent engagements include:

  • Representing a client in the sale of over 70 acres of land situate in the wider family of islands in The Bahamas, to a projected developer. Including securing numerous Addendums to extend the closing date, and issuing a Title Commitment as a condition to closing.
  • Representing the developer of a high end property situate in one of the family of islands of The Bahamas, in the review and revision of its Declaration of Covenants, Conditions, Restrictions and Easements establishing the Homeowners Association's management of the development and the role of the Declarant in the management of the development. Including the restrictive covenants, easements and exceptions that apply to the development, and establishment of an architectural committee for oversight of all proposed building plans.
  • Representing numerous purchasers in a high-end gated community comprising a golf course and marina, also situate in one of The Bahamas' wider family of islands, including review of the governing documents of the development and securing title commitments. Also requiring obtaining permits in accordance with the provisions of the International Persons Landholding Act, 1993.
  • Acting in various loan transactions including a foreign limited liability company as the Borrower, and requiring prior approval of the Central Bank of The Bahamas. Also requiring on behalf of the lender, capacity opinions from foreign counsel practicing in the jurisdiction where the limited liability company was established.
  • Representing a bank in a loan transaction advanced to a developer beneficially owned by a non-Bahamian, requiring prior approval of The Central Bank of The Bahamas, to allow the lender to advance the loan and take mortgages and debentures over certain of the assets of the company. This transaction included conducting an investigation of the documentary title to the property and issuing an opinion on title in the form of a report on title.
