Profile

Aliya Allen is a Partner in the firm's Corporate and Financial Services, and Tax Practices. She is also Co-Chair of Graham Thompson's Private Client Trusts Practice.

Her practice focuses primarily on banking, investment funds, securities, securitisation and capital markets, including regulatory matters such as FATCA, CRS, AML/CFT. Aliya has written extensively on the legislative and regulatory framework for financial services in The Bahamas and has played a leading role in the development and revision of industry defining legislation, notably the Investment Funds Act, 2019 and the Investment Condominium (ICON) Act.

Her practice also includes technology, FinTech, blockchain and digital assets. She has been a prominent player in the development of policy initiatives promoting these areas and isa recognized thought leader on the digital assets business sector in The Bahamas. She has written for highly regarded publications including, Chambers and Partners Global Practice Guides, and a white paper, "The Bahamas' place in a Crypto-Graphic World" which was cited in 2018 by the U.S. Law Library of Congress.

Recent engagements include:

  • Advising a global investment manager on the impact of economic substance requirements on its operations.
  • Acting for a global bank in a large-scale independent AML/CFT compliance audit.
  • Acting for a global bank with AUM in excess of $300 million undertaking a significant regulatory and compliance audit for the purposes of a global compliance project.
  • Acting for a syndicate of lenders in a $100 million facility to a utility company taking security over assets and revenue streams.
  • Acting for a major global bank as lead arranger in a billion-dollar facility to a company with global oil and gas assets taking security over local assets.
