Profile
Reilly counsels employers on labor-management relations, OSHA compliance and complex employment law issues. Reilly has worked on multiple union organizing campaigns and counseled employers through the representation petition process. Reilly is experienced in NLRB litigation and counsels employers on other labor-management relations issues, including collective bargaining and grievance and arbitration procedures. In his OSHA practice, Reilly assists clients across industries with safety policy development, OSHA inspection response and citation defense. He has handled multiple serious injury and fatality cases during both the investigative and litigation stages before state and federal OSHA. Reilly regularly counsels clients on traditional day-to-day employment law issues and handles employment litigation matters, including discrimination and wage-and-hour litigation in state and federal courts.
Reilly's OSHA experience includes assisting nationwide clients with regard to CDC, OSHA, state and local COVID-19 mandates and guidance. He plays a key role assisting companies across energy, healthcare, manufacturing and retail industries preventing and defending OSHA citations. Reilly has assisted clients with OSHA compliance and defending OSHA citations in California, Illinois, Indiana, Florida, Georgia, Kentucky, Massachusetts, Michigan, Missouri, North Carolina, South Dakota, Virginia, and Washington.
Reilly has defended clients in a variety of traditional employment matters, including Title VII employment discrimination claims, Family Medical Leave Act claims, Fair Labor Standards Act class actions and state law public policy claims. Reilly also has extensive experience representing clients in front of government agencies, including the Equal Employment Opportunity Commission and the National Labor Relations Board.
Reilly also works closely with clients on employment policy matters, including advocacy for changes in law through the administrative rulemaking process, amicus briefs or impact litigation. Reilly has drafted comments related to DOL, OSHA, and NLRB proposed rules for multiple clients and industry groups, and has extensive experience with the administrative comment process.
