Profile
Nkateko Hlongwane is an Associate at ENS in the Corporate Commercial practice.
Her experience is in general commercial law and regulatory matters across the pharmaceuticals and healthcare, medical schemes, foodstuffs, and liquor industries.
Her primary responsibilities include drafting legal opinions and advice across various areas of law, including pharmaceutical and healthcare, foodstuffs, liquor, and consumer protection; reviewing commercial agreements; conducting due diligence investigations and drafting due diligence reports; drafting submissions on proposed legislation and regulations; and providing general advice on company law matters.
Nkateko assists clients in establishing operations and navigating regulations in her areas of expertise by advising on the incorporation of new companies in South Africa and related requirements, advising on specific registrations and licensing requirements for entities within regulated industries such as importers, distributors, and manufacturers of medicines and medical devices, and preparing compliance questionnaires and checklists to assist clients in understanding specific compliance requirements.
Nkateko has broad experience in healthcare regulatory matters, foodstuffs, company secretarial services, liquor industry compliance (including licensing, labelling, and marketing), gambling, and consumer protection law in South Africa.
Nkateko’s notable project experience includes assisting with the National Health Insurance Act 20 of 2023 litigation; preparing submissions to the National Department of Health regarding the Council for Medical Schemes’ Low-Cost Benefit Option Report; preparing submissions to the Department of Trade, Industry and Competition regarding the Draft Interim Block Exemption for Tariffs Determination in the Healthcare Sector (2025); and preparing submissions to the South African Health Products Regulatory Authority regarding the ‘Policy Position on Enabling Local Manufacture’.
Nkateko has contributed to publications in the field of franchise law in South Africa for the International Trademark Association (INTA).
