Profile

Marika is a commercial litigator focused on resolving complex business disputes for clients in the energy, electricity, construction, and real estate sectors. She represents oil and gas companies, power producers, developers, service providers, and boards of directors in litigation and arbitration matters.

Marika has particular depth of experience with contractual disputes, including in relation to gas handling and transportation agreements, joint operating agreements, co-ownership arrangements, oil and gas purchase and sale agreements, power purchase agreements, and construction agreements. Her practice also includes environmental commodities disputes involving renewable energy credits, emission performance credits, and emission offset credits, as well as matters involving director and officer liability and multi-party commercial disputes with misrepresentation, conspiracy, and fraud allegations.

Recognized by Benchmark Litigation as one of Canada's Top 100 Women in Litigation, Marika is highly regarded for her clear-eyed risk assessment and practical counsel. She works with clients to chart the most proportionate path to resolution-one that weighs litigation costs, business disruption, and outcome probability against the value at stake.

* Litigation counsel to an LNG company in a contract interpretation dispute with a gas plant operator concerning processing fee calculations and allocation of plant operating costs under a gas handling agreement.
* Arbitration counsel to a real estate joint venture, its directors and officers, and majority investors defending breach of fiduciary duty and misrepresentation claims seeking damages, disgorgement, and unwinding of significant transactions.
* Litigation counsel to former directors, officers, and shareholders of a gravel company in the defence of a fraud and negligent misrepresentation claim by a lender seeking to impose liability for loans advanced to the successor company post-acquisition.
* Litigation counsel to a power generation company seeking an injunction and damages to restrain unauthorized commercial marina operations on lands adjacent to a hydroelectric facility.
* Litigation counsel to an electricity generation developer and its president and CEO defending fraud, conspiracy, and professional negligence claims seeking tracing, disgorgement, and Mareva relief arising from a failed solar EPC project.
* Litigation counsel to corporate defendants in a complex surety bond dispute, defending claims by a surety for performance bonds and pursuing professional negligence claims against insurance brokers and legal counsel for failures to discharge indemnity obligations following a corporate sale.
* Litigation counsel to a gas producer and midstream operator in a multi-party dispute involving conspiracy allegations, breach of contract claims, and third-party actions arising from gas processing and transportation agreements.
