Kindall James is a labor and employment attorney with vast experience defending employers in a wide variety of employment-related disputes before state and federal courts in Texas and Louisiana, state and federal agencies, and private arbitrators. She handles disputes alleging violations of the Fair Labor Standards Act, Title VII of the Civil Rights Act of 1964, Section 1981, the Age Discrimination in Employment Act, the Family and Medical Leave Act, the Americans with Disabilities Act (ADA), ERISA, and other federal and state laws.

Kindall also has extensive experience representing plaintiffs and defendants in litigation involving non-competition and non-solicitation agreements, trade secrets, and unfair competition.

In addition to her litigation practice, Kindall routinely represents clients in connection with day-to-day HR and personnel matters, including conducting workplace investigations, advising clients with respect to employee discipline and terminations, and assisting clients in responding to employee requests for accommodation and leave. She also assists employers with what she likes to call “defensive drafting” of key policies, personnel forms, and disciplinary documents that help mitigate risk in the face of employment claims. Finally, Kindall routinely assists clients in preparing and negotiating employment-related contracts, including executive employment agreements, severance agreements, agreements related to commissions and other incentive compensation, and non-competition, non-solicitation, and confidentiality agreements.
