Profile
Denise H. Field is Shareholder of the San Francisco office and Co-Chair of the Equipment Leasing Industry Group. She focuses her practice on commercial, general business, creditors' rights, and financial institutions litigation in state and federal court. She represents equipment lessors, banks, commercial lenders, mortgage lenders, and businesses of all sizes.
Ms. Field has significant experience representing equipment lessors and secured lenders in litigation, equipment recovery, fraud investigation and workout agreements. She represents financial institutions in litigation including matters involving creditors' rights, provisional remedies and post-judgment enforcement, fraudulent transfers and disputes relating to secured and unsecured lending. Ms. Field has experience defending financial institutions in complex litigation, consumer class actions and litigation involving fraud claims, federal consumer credit laws, unfair business practices and other commercial matters.
Ms. Field also assists clients by providing preventative advice and creative options to successfully resolve business disputes.

Professional Career
- Regularly represents banks, factors, commercial lenders and equipment lessors in debt recovery and collection actions, utilizing prejudgment remedies including writs of attachment and writs of possession, receiverships, temporary restraining orders and seeking damages for fraudulent transfers.
- Regularly advises and represents equipment finance and leasing companies in a wide variety of industries including technology, construction, energy, medical, aviation, manufacturing, and transportation.
- Lead counsel representing bank in a successful motion to dismiss claims, including fraud, intentional interference with prospective business advantage, RICO, breach of contract and violation of Cal. Bus. and Prof. Code §17200. Buena Vista, LLC v. New Resource Bank, 2011 WL 250361 (N.D. Cal. Jan. 26, 2011).
- Successfully defended commercial lenders in litigation, including complex litigation, class action suits, seeking damages for claims including breach of fiduciary duty, unfair and deceptive business practices, fraud and negligence.
- Obtained dismissals of suits against financial institutions seeking damages for claims including negligence, fraud, breach of fiduciary duty, unfair business practices and elder abuse.
- Represents mortgage companies in a wide range of litigation involving repurchase obligations, contract disputes, foreclosure and fraud.
- Represents a wide variety of businesses in contract, business tort, and fraud actions.
- Represents institutions and businesses in obtaining non-dischargeable judgements in adversary proceedings.
