Mr. Chang Hyun SONG is a partner at D&A LLC. His practice is primarily focused on Administrative Procedure & Litigation, Labor & Employment, Criminal, General Civil Disputes, Construction & Real Estate, and Tax Litigation.

Mr. Song has served as a prosecutor and judge for over ten years and handled criminal and civil litigation cases in various fields. After his retirement, Mr. Song was appointed the director of the Litigation Division of the Ministry of Justice and accumulated expertise in various administrative litigation fields by overseeing the administrative litigation for government ministries, local governments, and public institutions.
While serving as the director of the Administrative Litigation Division of the Ministry of Justice, Mr. Song directed administrative litigation cases against central administrative agencies, local governments, and public corporations in various fields, such as tax, antitrust and competition, construction, health and medical services, and general administration. He also handled constitutional adjudication trials, such as constitutional petitions for the National Security Act and the death penalty, as well as major administrative litigation cases, such as the suspension of execution related to quarantine passes and DLF-related disciplinary revocation actions against bank presidents. In addition, he handled a number of administrative appeals, such as cases involving refugees, immigration offices, and information disclosure against the Minister of Justice. Using these experiences as a basis for his expertise, Mr. Song serves as a non-standing member of the Central Administrative Appeals Commission.
As the head of D&A’s Administrative Team, Mr. Song has handled various administrative litigation cases, such as a lawsuit seeking the revocation of penalty surcharges against market wholesalers, a lawsuit seeking the revocation of disposition collecting subsidy recovery from a social welfare corporation, and a lawsuit seeking the revocation of the disposition of waste charges to the Korea Land and Housing Corporation. He has also provided legal advice and handled litigation against public corporations, such as claims for damage against construction unions by Korea Land and Housing Corporation.

  • Introduction of a regulating system for holding companies: Imposed specific enforcement ordinances such as a restriction on the debt ratio of holding companies and banning the possession of affiliates
  • Establishment of judgment standard for corporate action: Promoted enactment of corporate action regulating standards following his appointment as the Section Chief
  • Establishment of a reward system for reporters of corporate action: Arranged a reward system for reporters with clear evidence
  • Acquisition of Shinsegi Telecom by SK Telecom: Imposed corrective action limiting share percentage on the wireless communications market after analyzing the condition of the competition following the development of information and communication technology
  • Acquisition of Kia Motors by Hyundai Motors: Imposed corrective action regulating price in the market for trucks weighing less than one ton where market-dominant position occurs
  • Price fixing for LPG: Took measures against implied price fixing between LPG suppliers
  • Price fixing for national and international airlines’ transportation: Took measures against the collusion of transportation surcharges
  • Tie-in sale by Microsoft: Handled formal rejection of tying in an Internet search engine and music streaming program into sales
  • Exclusive trading of Intel: Took measures against the act disturbing the use of competitor’s computer chip
  • Exclusive trading of Qualcomm: Took measures against the act of pressuring not to use competitor’s chip
  • Reduction of mileage benefit by an airline: Took measures by regulating the act as an offence against consumer interests
  • Abuse of market power by Qualcomm (2nd Qualcomm case): Responded to inspection procedure by the Fair Trade Commission on behalf of Qualcomm
  • Acquisition of Nokia by Microsoft: Brought out the very first motion of consent after the introduction of the system
  • Collusion of international truck industry: Won a lawsuit by pointing out the Fair Trade Commission’s juridical unreasonableness
