Profile
Carly Miller is a construction litigator with a wide array of experience representing clients on projects around the country and the world. Carly represents general contractors, EPC contractors, owners and subcontractors on a variety of projects, large and small, public and private, international and domestic.
Carly helps her clients identify, mitigate, and resolve the many risks faced on their construction projects. She advises clients on various types of projects, including hospitals, embassies and other overseas government projects, industrial projects, hotel or condo projects, and many others. A substantial part of her practice focuses on renewable energy and power projects. She routinely advises contractors, owners, suppliers, and subcontractors on solar facilities, battery energy storage facilities, and hydroelectric facilities.
Carly regularly evaluates the many potential issues and risks on any given project — everything from delay and disruption to differing site conditions to project financing issues. Carly helps her clients navigate these risks before the contract is signed, during project performance, and all the way through contract closeout and, when necessary, dispute resolution. She frequently advises clients regarding general project administration, change order negotiation, claim preparation and defense, and the drafting of project correspondence. Carly also regularly advises clients on contract reviews working opposite owners, contractors, subcontractors, and engineers. She has helped negotiate EPC agreements and design-build agreements for large, complex construction projects including solar power plants, self-storage facilities, office buildings, and hotels.
If her clients are unable to resolve their disputes during the project, Carly then represents them in dispute resolution, whether it be state or federal litigation, domestic or international arbitration, or mediation. She has experience litigating, arbitrating, and advising on claims across the United States and abroad, including Chile, Mexico, Panama, and Puerto Rico. Her dispute resolution experience includes arbitrations under the rules of the American Arbitration Association (AAA), the International Chamber of Commerce (ICC), and the International Centre for Dispute Resolution (ICDR). Carly also has represented clients in state and federal court and before various governmental boards, including the Civilian Board of Contract Appeals and Armed Services Board of Contract Appeals.
In addition, Carly has represented clients in other industries in state and federal litigation or arbitration matters. She also has federal jury trial experience involving civil rights violations of incarcerated individuals on a pro bono basis.
Carly and her husband, Elliot, have three young boys (Theo, Mills, and Spencer) and one not-so-young dog (Jules). In her free time, Carly enjoys spending time outdoors and exploring new places with Elliot and the boys, practicing tennis (and recently pickleball!), and playing mahjong with friends. She loves to travel, and her favorite places to visit are the slopes in Park City and the beaches along 30A in Florida.
